Terms and Conditions

Introduction
The use of the All About Me Card Personalisation Service is subject to the following terms and conditions. Please read through these terms very carefully.

This Card Personalisation Service (the 'Service') is provided by First Bank of Nigeria Plc (the 'Bank').
The Service includes the uploading of images to our online image gallery
In these terms and conditions, First Bank of Nigeria is called, 'the Bank', 'We' 'Us.'
An image from our online image gallery, including any special limited edition image and/or any image uploaded to the gallery by another website user, is called a 'Gallery Image'.
A computer image file that you have uploaded to be printed onto your card and/or added to our online image gallery is called 'Uploaded Image'.
A Card with either an Uploaded Image or a Gallery Image printed on it is called a 'Personalised Card'.
These terms apply to each request you make for an image to be printed onto a debit/credit card (a 'Card')

Availability
1.1 To use the Service, you must have a FirstBank of Nigeria PLC Naira denominated savings or current account.
You must be aged 18 or over to add an Uploaded Image to our online image Gallery.
Service
2.1. The Service enables you to have an image of your choice (an 'Image') printed on a Naira MasterCard
2.2. You can choose an Image from our gallery or upload your own Image.

Uploading your own Image
3.1. You can upload your own Image for printing on your Debit Card only if;
(a) The Image meets our Image Guidelines and the Image does not contain any computer virus or malicious code.
(b) You are the owner of all copyrights in the Uploaded Image. This means that either you must have created the entire image yourself (e.g. if the image is a photograph you must have taken the photograph, or if the image is a drawing you must have drawn it yourself).
(c) The Image does not contain any offensive material.

3.2. Our decision to reject an Uploaded image or related image title and screen name is final. We will not enter into any correspondence with you about why the image has been rejected.
We will review the image and may reject it if:
(a) It does not meet our Image Guidelines; or
(b) We reasonably consider that it is not suitable for use on a debit card.
(c) If it is a copyrighted image (where you are not the owner).

3.3. By uploading an Image:
(a) You confirm that the Image meets the requirements set out in condition 3.1 above; and
(b) You grant us the right to use, modify, and print the Image for the purpose of providing the Service to

4. Uploaded Image Responsibilities
In relation to each Uploaded Image, you grant to us the right to use, modify, print, store and reproduce the Uploaded Image for the purpose of providing a Personalised Card to you. We may pass these rights on to companies that help us in relation to the Card Personalisation Service.
In relation to each Uploaded Image you will ensure that:
You are the owner of all copyrights in the Uploaded Image. This means that you must have created the image yourself.
You have obtained the express consent of any person whose image appears in the Uploaded Image.
You have obtained the express consent of a parent of, or a guardian of, any person under 18 who appears in the Uploaded Image.
The Uploaded Image does not contain any computer viruses; and
The Uploaded Image complies with he Uploaded Image Rules set out above.

5. Uploading an Image from our gallery
5.1. You can choose an Image from our gallery and, subject to such restrictions as we may in our discretion impose in respect of selected images for technical or other reasons, may manipulate the appearance of it before submitting it.
5.2. All intellectual property rights in the images in our gallery are owned by us or by our licensors and none of these images may be used by you for any purpose other than as an Image on your Debit Card.
5.3 If we add an Uploaded Image to our online gallery then the Uploaded Image will be publicly available and anyone who accesses the online image gallery may be able to see it. The related image title and screen name may appear alongside the Uploaded Image. Access to the online Image Library will not be restricted.

6. Fees:
6.1. In order for us to issue you with a Personalised Card you need to pay us a fee.
6.2 The Bank shall inform you what fees and commission will be required from you to enable you subscribe to the service.
6.3 We will debit the account tied to the Personalised Card.

7. Replacing your Personalised Card
7.1. You can change the Image on your Personalised Card at anytime by ordering a replacement Personalised Card using the Service.

8. Delivery
8.1. We will aim to get the Personalised Card to you within 5 working days from the date of submission of when we accept your order (via mail). You must contact us immediately if you do not receive your Personalised Card within the specified period.


9. Using information about you
9.1 We will collect, use, share and store personal and financial information about you as set out in Section 10 'Using information about you' of your Retail Customer Agreement.
9.2 We will remove the Uploaded Image from the online image gallery as soon as we reasonably can after we receive a verified request from you to remove it. Details of how you can ask us to remove an Uploaded Image from our online image gallery are published on the Cards Personalised Website.

10. Existing Cards
If you already have a Naira MasterCard card that you use with your account it will stop working once you activated your Personalised Card.
11. Term
11.1. Your All About Me Card will remain valid for the period specified on the front of the Card. You Card will no longer be valid after the end-date shown on the front of the card.
11.2. Any new card will be issued to you with the image on your most recent card, if the image is still available on the Image Gallery.

12. Termination
12.1. We may suspend your use of the Service or end this agreement with you immediately if:
(a) You breach your agreement with us;
(b) We are required to do so by any party assisting us in providing the Service; or
(c) We decide to discontinue the Service.
12.2. We may suspend your use of your Personalised Card immediately and cancel it if it is brought to our attention that the Image infringes the rights of a third party. . We will investigate such an allegation promptly in good faith and may issue you with a standard Debit Card whilst we do this taking into account the likely length of the investigation and any actual or anticipated inconvenience to you. We will notify you when we have completed our investigation and either lift the suspension of your Personalised Card or cancel it depending upon the outcome. Our decision in this respect will be final.
12.3. Where we withdraw or suspend the Service, end our agreement with you or suspend or cancel your use of your Personalised Card, you agree to return your Personalised Card or destroy it in line with any instructions we give you.

13. Liability
13.1. If you upload an Image that infringes the rights of any other person, you will pay any losses, costs or expenses we, our suppliers, one of our subsidiaries or group companies suffer as a result of possession, printing, modification or other use of the Image.
13.2. The Image will be printed on your Personalised Card as it is provided to us by you. We will not be liable for the poor quality of the reproduction of the Image to the extent that this attributable to the quality of the original as uploaded by you or for the positioning of the Image on the Personalised Card as a result of the way in which you uploaded or manipulated it.

14. Relationship with Bank Account and Debit Card Terms And Conditions
This Contract is separate from and will not change the terms and conditions that tell you how you can use your bank account and the terms and conditions that tell you how you can use your Card. If there is any conflict between the terms of the Contract and the conditions covering the use of your bank account and Card then the conditions covering the use of your bank account and card will apply. Termination of this Contract will not affect the rules covering the use of your bank account and card.
